ORDINANCE NO. ~
(Series of 1976)
AN ORDINANCE AMENDING SECTION 24-3.7 OF THE
ASPEN MUNICIPAL CODE BY ADDING SUBSECTION
(m) THERETO, i~ICH SAID SUBSECTION PROVIDES
THAT THERE SHALL BE PERMITTED, WITHIN ALL
RESIDENTIAL DISTRICTS WITHIN THE CITY,
OWNER-OCCUPIED OR NONPROFIT GROUP HO~-~S
FOR THE EXCLUSIVE USE OF LIMITED NUMBERS
OF AGED PERSONS, PROVIDED THAT SUCH PERSONS
DO NOT NEED SKILLED AND INTERMEDIATE CARE
FACILITIES
WHEREAS, colorado's House Bill 1058 has required
that all municipalities recognize the establishment of group
homes for the aged within residential zone districts and do
so by zoning code amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO: Section 1
That the Municipal Code of the city of Aspen, Colorado,
is hereby amended by adding a subsection to Section 24-3.7
which said subsection reads as follows:
(m) In all residential districts there shall
be permitted the establishment of owner-occupied
or nonprofit group homes for the exclusive use
of not more than eight persons (sixty years of
age or older) per home, provided that such persons
do not need skilled and intermediate care facilities.
A group home for the aged established under this sub-
section shall not be located within seven hundred fifty
feet of another such group home. Nothing herein
shall be construed to exempt such group homes from
compliance with any state, county or municipal
health, safety and fire code provisions.

Section 2
If any provisions of this ordinance of the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the
invalid provision or application, and to this end the pro-
visions of this ordinance are declared to be severable.
Section 3
That a public hearing on this ordinance be held on
~ /~ , 1976, at 5:00 p.[l. in
the City Council Chambers, City Hall, Aspen, colorado, fifteen
(15) days prior to which hearing notice of the same shall be
published once in a newspaper of general circulation within
the City of Aspen.
