HomeMy WebLinkAboutordinance.council.002-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1975) AN ORDINANCE AMENDING SECTION 8½-11 OF THE ASPEN MUNICIPAL CODE CONCERNING PENALTIES FOR REPORTING OF FALSE ALARMS; ~ICH AMENDMENT ELIMINATES THE PENALTY FOR REPORTING OF FALSE ALARMS AND THE PROVISION PERMITTING A LIMITED NUMBER OF FALSE ALARMS EACH MONTH; BUT WHICH IMPOSES AN ASSESSMENT ON EACH PERSON, FIRM OR CORPORATION WHICH, BY ITSELF, ITS EMPLOYEES, AGENTS, GUESTS OR INVITEES, NEGLIGENTLY CAUSES THE REPORTING OF A FALSE ALARM; SETTING THE ASSESSMENT AT TWENTY-FIVE ($25.00) DOLLARS FOR EACH SUCH ALARM; AND PRO- VIDING FOR THE REVOCATION OF ANY LICENSE ISSUED UNDER CHAPTER 8½ WHEN A FALSE ALARM IS ATTIRUBTABLE TO THE IN- STALLATION OF FAULTY OR INAPPROPRIATE EQUIPMENT BY THE LICENSEE (CENTRAL OFFICE EMERGENCY ALARM SYSTEM) AND SAID LICENSEE FAILS TO IMMEDIATELY RECTIFY THE SAME WHEREAS, the City Council has been advised that enforcement of Section 8½-11 as it now stands has presented difficulties and inequities and often misses the objective of Section 8½-11, which is to compensate the City for negligently caused false alarms and encourage more careful use of emergency alarm systems, and WHEREAS, certain amendments to Section 8½-11 have been recommended, and the City Council wishes to adopt the same, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO. Section That Section 8½-11 of the Municipal Code of the City of Aspen, colorado, is hereby amended to read as follows: RECORD OF PROCEEDINGS 100 Leaves "Sec. 8½-11. False alarms due to negligence prohibited; assessment. Whenever any person, firm or corporation owning or leasing premises for the protection of which an emergency alarm system is keyed into the police department in any way, shall, by itself, its employees, agents, invitees or guests, negligently cause the reporting of a false alarm to the police department through such system, such person, firm or corporation shall be assessed by the Finance Director, a fee of twenty-five ($25.00) dollars for every such false alarm, which fee is declared to be designed to compensate for the public expense in responding to the same and to discourage careless- ness in the use of alarm systems so as to enhance public peace and safety. The violator shall be responsible for paying such assessments to the City Finance Director within ten (10) days follow- ing receipt of written notice thereof from the City. In the event any false alarms are reported and such is attributable to the installation of faulty or inappropriate equipment by any licensee under this Chapter, failure of such licensee to immediately replace or repair the same shall be grounds for revocation of the license provided for by Section 8½-11 herein." -2- RECORD OF PROCEEDINGS 100 Leaves Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable.
