AN ORDINANCE ANNEXING A TRACT OF LAND OWNED BY 700 HOPKINS
AVENUE APARTMENTS, A GENERAL PARTNERSHIP (SAID TRACT CON-
TAINING 2272 SQUARE FEET, MORE OR LESS) AND ANNEXING SAID
PROPERTY ACCORDING TO THE COLORADO MUNICIPAL ANNEXATION ACT
WHEREAS, there has been submitted a petition for
annexation by 700 Hopkins Avenue Apartments, a general
partnership, of Aspen, Colorado, which petition has been pre-
sented pursuant to the provisions of the Colorado Municipal
Annexation Act of 1965, C.R.S. 1973, Title 31, Article 8
thereof, and
WHEREAS, said petition has been considered by the
City Council of the City of Aspen, and said City Council
having found that:
i. The signature on the petition represents the
owners of One Hundred (100%) Percent of the land included in
the tract to be annexed;

2. i~ot less than one-sixth (1/6th) of the perimeter
area to be annexed is contiguous to the City of Aspen;
3. There exists a community of interest between the
tract to be annexed and the City of Aspen, the tract to be
annexed is urbanized, and it is presently integrated with the
City of Aspen;
4. The annexation will not affect the constitution of
any existent school districts;
5. The petition satisfies the statutor!, requirements
of the Municipal Annexation Act bo~h as to substance and form;

WHEREAS, Section 31-8-107(1) (g) of the Municipal
Annexation Act provides that where a petition for annexation
is signed by the owner(s) of One Hundred (100%) Percent of
the property proposed to be annexed, the City Council may,
by ordinance, annex without notice or hearing, and without
election, and the City Council wishes to so proceed,
I~IOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That the following described tract, situate in Pitkin
County, Colorado, be and hereby is annexed to the City of Aspen,
pursuant to the provisions of the Colorado Municipal Annexation
Act:
A tract of land situated in the SE¼ of Sec.12,
T10S, R85W of the 6th P.M.,Pitkin County, Colorado,
and being part of the Mary B. No. 2 lode mining
claim, survey no. 19640, said tract is more fully
described as follows:
Beginning at a point on line 7-8 Aspen Townsite,
being also on the Westerly line of Sixth Street
whence the Northeast corner of Lot S, Block 19,
City of Aspen bears N.14o50,49- E. ~1.00 feet;
thence N.55°18'18,, W. 95.68 feet along said line
7-8 to a point on the Westerly line of Lot Q said
Block 19; thence S.14o50,49,, 7~. 41.49 feet along
the Southerly extension of the Westerly line of
said Lot Q to a point on the extension of the
Northerly line of West Hopkins Avenue; thence
S.75°09'11" E. 90.00 feet along said extension of
the Northerly line of West Hopkins Avenue to a
point on the extension of the Westerly line of
Sixth Street; thence N.14o50,49,, E. 9.00 feet
along said extension of Sixth Street to the point
of beginning containing 2272 square feet more or
less, and
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid

provisions or applications, ~nd to this end the provisions or
applications of this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on
the ~_ day of ~~, 1975, at 5:00 P.M. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
