(Series of 1975) AN ORDINANCE ANNEXING TO THE CITY OF ASPEN THREE (3) ENCLAVES OF LAND ENTIRELY CONTAINED WITHIN THE BOUNDARIES OF THE CITY OF ASPEN AND ANNEXING THE SAME PURSUANT TO THE PROVISIONS OF SECTION 31-8-106(1), C.~.~. 1973, THE COLORADO MUNICIPAL ANNEXATION ACT WHEREAS, the City of Aspen to annex three (3) enclaves of the city of Aspen pursuant to Section 31-8-106(1) colorado Municipal Annexation Act, and the Mayor of theCity of Aspen has petitioned land within of the WHEREAS, the city Council of the City of Aspen did, by its Resolution No. 31, Series of 1974, determine said petition to be in compliance with the requirementS of C.R.S. 1973, Section 31-3-107, colorado Municipal Annexation Act, and WHEREAS, the city Council has further, by said resolution, determined that the tracts proposed for annexation are unincorpor- ated lands entirely contained within the boundaries of the City of Aspen, >.ave been so surrounded for a period of not less than three (3) years, and, consequently, are eligible for annexation under said Section 31-8-106(1), and WHEREAS, the City Council wishes to annex the enclaves proposed for annexation and do so by ordinance, all as provided in the 1965 colorado Municipal Annexation Act, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 ?hat there be annexed to the city of Aspen the following described tractS of land situate within the County of Pitkin and State of colorado, and more particularly described as follows: RECORD OF PROCEEDINGS 100 Leaves Parcel A Lots 4 and 5, Pitkin Mesa Subdivision, containing 0.739 acres, more or less. Block 1, Parcel B Lot 7, West Aspen Subdivision, ing 0.348 acres, more or less. Filing 1, contain- Parcel C A tract of land in the NW¼, Sec. 12, T10S, R85W of the 6th P.M., nore fully described as follows: Beginning at a point whence the one-quarter corner between Section 11 and Section 12, T10S, ~85W of o , - 1394.64 feet; the 6th P.M. bears S.46 08 15 W. thence S.13°34' E. 200.00 feet; thence N.76°26' E. 122.30 feet; thence N.25°14' W. 204.22 feet; thence S.76o26' W. 81.00 feet to the point of beginning, containing 0.47 acres, more or less. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable.
