HomeMy WebLinkAboutordinance.council.044-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1975) AN ORDINANCE APPROPRIATING $100,000.00 OF 1974 SIXTH AND SEVENTH PENNY TAX PROCEEDS TO THE RESERVE FUNDS ESTABLISHED ON ADOPTION OF THE RESPECTIVE TAXES; OF WHICH AMOUNT $50,000.00 SHALL BE ALLOCATED FOR THE SIXTH PENNY, AND $50,000.00 FOR THE SEVENTH PENNY RESERVE FUNDS, ALL OF WHICH IS REQUIRED BY THE PROVISIONS OF ORDINANCE 21, SERIES OF 1972, AND ORDINANCE 24, SERIES OF 1973 WHEREAS, there was retained in 1974 the required Fifty Thousand ($50,000.00) Dollar bond reserve in each of the Land Acquisition and Improvement and Transportation Funds representing the annual bond reserve from Sixth and Seventh Penny Sales Tax Proceeds mandated by Ordinance 21, Series of 1972, and Ordinance 24, Series of 1973 (which ordinances established the Sixth and Seventh Penny Sales Taxes), and WHEREAS, although such amounts were reserved, they were never appropriated such as to permit their transfer to the Sales Tax Bond Reserve, and WHEREAS, the City Council wishes to rectify this matter and provide for the transfer of said funds, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That there be appropriated to the Sales Tax Bond Reserve the amount of One Hundred Thousand ($100,000.00) Dollars which amount shall consist of Fifty Thousand ($50,000.00) Dollars of 1974 unappropriated fund balance in the Land Acquisition and Improvement Fund, and Fifty Thousand ~50,000.00) Dollars of 1974 unappropriated fund balance in the Transportation Fund. RECORD OF PROCEEDINGS 100 Leaves Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such in- validity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid pro- visions or applications, and ~o this end the provisions or applications of this ordinance are declared to be severable.
