AN ORDINANCE REPEALING SECTION 5 OF ORDINANCE 31, SERIES OF
1971, WITH RESPECT TO THE TRAFFIC PENALTY ASSESSMENT SCHEDULE
INCORPORATED THEREIN, WHICH REPEAL WILL ALLOW SCHEDULING OF
SUCH FINES BY THE ASPEN MUNICIPAL COURT PURSUANT TO RULE
210(b) (4) OF THE COLORADO MUNICIPAL COURT RULES OF PROCEDURE
WHEREAS, the City Council wishes to repeal the earlier
enacted schedule of penalty assessments for traffic offenses con-
tained in Ordinance 31, Series of 1971,
~OW, THEREPORE, DE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That it does hereby repeal that provision of Section 5,
Ordinance 31, Series of 1971, readopting "Section 22-14 Penalty
assessment and schedule" of the previous code, ~ich repeal is
intended to permit the scheduling of penalty assessments by the
Aspen Municipal Court pursuant to Rule 210(b) (4) of the Colorado
Municipal Court Rules of Procedure.
Section 2
zf any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions of applications of
the ordinance which can be given effect without the invalid pro-
visions or applications, and to this end the provisions or
applications of this ordinance are declared to be severable.
Section 3
~ public hearing on this ordinance shall be held on
the ~ day of ~ , 1975, at 1 P. ~. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
