ORDINANCE NO. 67

AN ORDINANCE REPEALING AND REENACTING SECTION 24-3.7D3 OF THE
ASPEN MUNICIPAL CODE AMENDING THE OPEN SPACE REQUIREMENT OF THE
ZONING CODE SO AS TO REQUIRE THAT ALL MANDATORY OPEN SPACE BE
PROVIDED AT GRADE
WHEREAS, the City Council has had occasion to review new
developments which have provided required open space above or be-
low grade and has determined that the objectives of the open space
requirement would be best served if open space were provided at
grade,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That Section 24-7.3, Subsection D3 of the Municipal
Code of the City of Aspen, Colorado, is hereby amended to read
as follows:
"3.

If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid pro-
visions or applications, and to this end the provisions or applic-
ations of this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on
, 1975, at 5:00 P.M. in the City Council Chambers,

City Hall, Aspen, Colorado, provided that notice of such hearing
shall have been published fifteen (15) days before such date in
a newspaper of general circulation within the City of Aspen.
