AN ORDINANCE AMENDING SECTION 13-47 OF THE CRIMINAL CODE SO AS TO
INCLUDE WITHIN THE DEFINITION OF TRESPASS THE PLACEMENT OF PROPERTY
ONTO THE PREMISES OF ANOTHER
WHEREAS, the criminal prohibition against trespass in-
cludes within its definition only an entry by one onto the property
of another, and the City Council wishes to expand the prohibition
to include the placement of personal property on the premises of
another,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
Aspen,
That Section 13-47 of the Municipal Code of the City of
colorado, is hereby amended to read as follows:
"Section 13-47 Trespassing Prohibited
It shall be unlawful for any person without legal
privilege to enter on or remain upon the premises
of another, to place personal property on the pre-
mises of another, or to fail or refuse to remove
himself or such property from such premises when
requested to do so by the owner, occupant or
person having lawful control thereof."
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such invalid-
ity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provisions
or applications, and to this end the provisions or applications of
this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on the
~ day of ~~ , 1975, at 5 P.M. in the City Council
Chambers, Aspen City Hall, Aspen, Colorado.
