AN ORDINANCE AMENDING SECTION 12-30 OF THE ASPEN MUNICIPAL CODE
CONCERNING BUSINESS LICENSING WHICH AMENDMENT PRECLUDES THE USE
OF CITY BUSINESS LICENSING SO AS TO INTERFERE WITH THE PRACTICE
OF ANY PROFESSION LICENSED BY THE STATE OF COLORADO EXCEPT SO
AS TO BRING THE BUSINESS OR AN APPLICANT INTO CONFORMANCE WITH
THE CITY BUILDING, ZONING, HEALTH, CRIMINAL AND OTHER CITY
ORDINANCES
WHEREAS, the City is desirous of modifying its business
licensing procedures to insure that license issuance does not inter-
fere with or usurp the professional licensing authority of the
State of Colorado when such authority has been exercised,
NOWr THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That the Municipal Code of the City of Aspen, Colorado,
is hereby amended by adding a Subsection (c) to Section 12-30, which
said Subsection reads as follows:
"(c)
Nothing herein shall be construed to permit
the license officer to regulate the practice
of any profession for which an applicant has
a valid state license. For purposes of this
section the wor~ 'regulate the practice' shall
mean to prescribe qualifications different from
or additional to those prescribed by the state
for the privilege of engaging in a specified
profession. All provisions of this Article II
shall be interpreted and applied only so as to
enforce the health, criminal, building, zoning
and other regulations of the City of Aspen and
not as an attempt to usurp or interfere with
the right of the State of Colorado to license
professional activity when the state has ex-
ercised such authority."
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such

invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions or
applications of this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on
the ~7 day of ~~ , 1975, at 5:00 P.M. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
