ORDINANCE NO. ~_~

AN ORDINANCE REPEALING AND REENACTING SECTION 4~24 OF THE
ASPEN MUNICIPAL CODE SUCH AS TO ELIMINATE THE PROVISION FOR PRO-
RATION OF THE LIQUOR LICENSE TAX FOR NEW LICENSES ISSUED AFTER
JANUARY FIRST OF EACH YEAR, AND RETAINING THE REQUIREMENT THAT
NO REBATE BE GIVEN TO BUSINESSES WHICH ARE DISCONTINUED PRIOR
TO THE EXPIRATION OF A LIQUOR LICENSE.
WHEREAS, Senate Bill 28 enacted by the Colorado General
Assembly provides for the licensing of liquor licenses for one
year from the date of issuance which eliminates the need for
providing for proration of the liquor occupation tax for licenses
issued after January first,
~OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That Section 4-24 of the Municipal Code of the City of
Aspen, Colorado, is hereby amended to read as follows:
"Section 4-24 No refund of tax
No refund of the tax required by this article
shall be made by reason of the discontinuance of the
business prior to the expiration of a license to sell
3.2% beer, malt, vinous or spirituous liquors."
Section 2
If any provision of this ordinance or the application there-
of to any person or circumstance is held invalid, such invalidity
shall not affect other provisions or applications of the ordinance
which can be given effect without the invalid provisions or applic-
ations, and to this end the provisions or applications of this
ordinance are declared to be severable.

A public hearing on this ordinance shall be held on the

Council Chambers, Aspen City Hall, Aspen, Colorado.
