ORDINANCE NO. 90

AN ORDINANCE AMENDING THE ASPEN ZONING CODE PROVIDING FOR THE
DESIGNATION OF PARK MAINTENANCE BUILDINGS AS CONDITIONAL USES
IN THE (P) PARK DISTRICT AND FURTHER DEFINING PARK MAINTENANCE
BUILDINGS AS THOSE CONTAINING OFFICE, GARAGE, VEHICLE AND TOOL
STORAGE, GREENHOUSE, AND SIMILAR USES PROVIDED ALL ARE LIMITED
TO PARK OPERATION AND MAINTENANCE PURPOSES
WHEREAS, upon recommendation of the Aspen Planning
and Zoning Commission the City Council has determined to expand
the conditional uses within the (P) Park Zone District such as
to, on review, permit construction of park maintenance build-
ings, and
WHEREAS, the City Council feels it necessary to
further amend the code by defining the phrase "park maintenance
building" in terms of the permissable uses of such facility,
NOW, THEREFORE, ~E IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Section 24-3.2 of the Municipal Code of the City
of Aspen, Colorado, hs hereby amended by the addition of Park
Maintenance Building to the list of CONDITIONAL USES within the
(P) Park Zone District.
Section 2
That Section 24-3.1 of the Municipal Code of the City
of Aspen, Colorado, is hereby amended by the addition of subsection
(CC) thereto which said subsection reads as follows:
"(CC) Park Maintenance Building A building
within park land used to store and repair
vehicles and equipment and also usable for
greenhouse and office purposes, provided
all uses are limited ~ park operation and
maintenance purposes."

If any provision of this ordinance or the application
any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid pro-
visions or applications, and to this end the provisions or applic-
ations of this ordinance are declared to be severable.
Section 3
That a public hearing be held on this ordinance on
~ C~!~l r>~op , 1975, at 5:00 P.~. in City Council Chambers,
City Hall, Aspen, Colorado, fifteen (15) days prior to which
hearing public notice of the same shall be published once in a
newspaper of general circulation within the City of Aspen.

law by the City Council of the City of Aspen, at its regular

Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions
or applications of this ordinance are declared to be severable.
Section 3
That a public hearing be held on ~~ ~ , 1975,
at 5:00 P.M. in the City Council Chambers, City Hall, Aspen,
Colorado, fifteen (15) days prior to which hearing notice of
the same shall be published once in a newspaper of general
circulation within the City of Aspen.
