HomeMy WebLinkAboutordinance.council.093-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1975) AN ORDINANCE AUTHORIZING FIRE FIGHTING EQUIPMENT, AMBULANCES, POLICE VEHICLES, OTHER EMERGENCY VEHICLES, PUBLIC, AND PUBLIC UTILITY VEHICLES TO ENTER AND PARK IN THE PEDESTRIAN MALL; FURTHER AUTHORIZING THE CITY MANAGER TO PERMIT, ON CONDITION, SERVICE AND DELIVERY VEHICLES TO ENTER AND PARK IN THE MALL; AND, FINALLY, AUTHORIZING THE CITY MANAGER TO PERMIT SERVICE AND DELIVERY VEHICLES TO PARK IN LEGAL PARKING AREAS IN EXCESS OF ANY TIME LIMITATIONS THEREIN WHEN NECESSARY TO RENDER SER- VICES, OR DELIVER MERCHANDISE. WHEREAS, the City Council is of the opinion that while its tourist needs require establishment of pedestrian malls and high turnover parking regulations within many areas of the City, the service, delivery and some medical vehicles occasionally re- quire a relaxation of access and parking limitations to provide private and public services, and WHEREAS, the City Council wishes to specifically authorize some types of vehicles to enter and park in malled areas, and, with permission of the City Manager, to allow delivery, service and medical vehicles to park in excess of certain time limitations throughout the City, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO. Section 1 That the Municipal Code of the City of Aspen, Colorado is hereby amended by adding a section, which said section reads as follows: "Sec. 22-12 Waiver of Parking Limitations (a) Contrary provisions notwithstanding, all fire fighting equipment, ambulances, police vehicles, other emergency vehicles, public, and public utility vehicles may enter into areas of the pedestrian mall and park therein when necessary to render medical, police, utility or other public services, but only at such times, RECORD OF PROCEEDINGS 1 O0 Leaves and for such periods, as necessary to render such services. (b) The City Manager may permit service, delivery, and vehicles of medical personnel to enter into areas of the pedestrian mall and park therein (for purposes of rendering services, delivering merchandise, and making vehicles available in case of medical emer- gencies) for such periods and under such conditions as he shall determine. (b) The City Manager may permit service, delivery, and vehicles of medical personnel to park in permissable parking zones for periods in excess of any time limitation, (for purposes of rendering services, deliver- ing merchandise, and making vehicles avail- able in case of medical emergencies) for such periods and under such conditions as he shall determine. (d) Nothing herein shall be construed to authorize vehicles to park in any area where parking is prohibited, or under conditions or in a manner otherwise prohibited by law." Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable.
