HomeMy WebLinkAboutordinance.council.096-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1975) AN ORDINANCE ZONING THREE (3) PARCELS OF LAND LOCATED ON THE EAST END OF ASPEN AND WITHIN THE PROPOSED CALLAHAN SUBDIVISION, TWO PARCELS HAVING BEEN RECENTLY ANNEXED TO THE CITY; ZONING PARCEL 1 (CONTAINING APPROXIMATELY FOUR ACRES) RURAL RESIDENTIAL; ZONING PARCEL 2 (CONTAINING APPROXIMATELY TWO ACRES) R-15 (RESIDENTIAL); and REZONING PARCEL 3 (CONTAINING SIX ACRES) FROM R-15 TO RURAL RESIDENTIAL WHEREAS, there has been presented to the City a proposed subdivision of properties owned by Frederic A. and Fabienne Benecit, and the Benedict Land and Cattle Company, known as the Callahan Sub- division, and WHEREAS, in order to give final approval to the proposal, it is necessary to zone two (2) parcels recently annexed to the City and included within the subdivision, and to rezone an area already within the City to accommodate a change of use, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the parcel of land fully described as Parcel 1 in Exhibit A (attached hereto and incorporated by this reference) recently annexed to the City of Aspen, be and hereby is zoned Rural Residential (RR) and enjoy the benefits and be subject to the limitations of such zone district all as described in Chapter 24 of the Aspen Municipal Code. Section 2 That that parcel of land fully described as Parc~ 2 in Exhibit A (attached hereto and incorporated by this reference) recently annexed to the City of Aspen, be and hereby is zoned R-15 (Residential) and enjoy the benefits and be subject to the limit- ations of such zone district all as described in Chapter 24 of the Aspen Municipal Code. Section 4 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the other provisions or applications of the ordinance which can be given effect without the invalid pro- visions or applications, and to this end the provisions or applic- ations of this ordinance are declared to be severable. Section 5 That a public hearing on this ordinance be held on ~. /~ , 1976, at 5:00 p.m. in the City Council Chambers, City Hall, Aspen, colorado, and that notice of such hearing be published once in a newspaper of general circulation within the city at least fifteen (15) days prior thereto.
