HomeMy WebLinkAboutordinance.council.098-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1975) AN ORDINANCE AUTHORIZING A SERIES OF TRANSFERS OF EXCESS MONIES AND APPROPRIATIONS WITHIN THE CITY'S DEBT SERVICE FUNDS; SPECIFICALLY THE SEVENTH PENNY SALES TAX FUND, THE SIXTH PENNY SALES TAX FUND, THE 1972 SALES TAX REFUNDING/ACQUISITION FUND AND THE 1970 PUBLIC PURPOSE BONDED DEBT FUND; AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ADOPTION WHEREAS, adjustments of the various debt service funds are necessary and must be done before the end of the calendar year, NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That revenues be recognized and expenditures be approved from the City's debt service funds as follows: 1973 Sales Tax Revenue Bonds Unappropriated Fund Balance Appropriations Revenues Expenditures $ 9,910.00 Transfer excess fund balance to Mall/Transportation Seventh Penny Sales Tax Fund $ 9,910.00 Sales Tax Bond Debt Reserve Fund Interest Income 12,383.00 Transfer from 1972 Sales Tax Refunding/ Acquisition Bond Fund (Revenues held in wrong fund) 50,000.00 Transfer excess appropriated debt service to land acquisition Sixth Penny Sales Tax Fund 4,060.00 Transfer excess appropriated debt service to Transportation/Mall Seventh Penny Sales Tax Fund 7,439.00 Transfer excess revenues to 1972 Sales Tax Refunding/Acquisition Bond Fund 6,483.00 Unappropriated Fund Balance 44,401.00 RECORD OF PROCEEDINGS 100 Leaves 1972 Sales Tax Refunding/Acquisition Bond Fund Revenues Transfer from Sales Tax Bonded Debt Reserve Fund (excess revenues) Transfer to Sales Tax Bonded Debt Reserve Fund (reserves held in wrong fund) Transfer Excess Appropriated Debt Service to Land/Open Space Sixth Penny Sales Tax Fund Unappropriated Surplus Appropriations Expenditures $ 6,483.00 $ 50,000.00 72,341.00 28,824.00 1970 Public Purpose Bonded Debt Debt Service Transferred from General Fund 2,320.00 Bond Coupon Redemption 2,320.00 Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid pro- visions or applications, and to this end this ordinance is declared to be severable. Section 3 That it is hereby declared that an emergency exists requiring the immediate adoption of this ordinance inasmuch as all budget ordinances for 1975 revenues or expenditures must be fully approved by the City's governing body before the end of the calendar year; that this ordinance be approved only be the unanimous vote of councilmen present or a vote of five councilmen, whichever is less; that this ordinance be passed at two meetings of council; that neither a public hearing nor first publication be required; that this ordinance be published within ten (10) days after final passage, and that it take effect upon final passage.
