HomeMy WebLinkAboutordinance.council.100-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. /Od) (Series of 1975) AN ORDINANCE TRANSFERRING EXCESS APPROPRIATED DEBT SERVICE FROM THE SEVENTH PENNY SALES TAX BONDED DEBT RESERVE FUND AND THE 1973 SEVENTH PENNY SALES TAX REVENUE BONDS TO THE SEVENTH PENNY FUND; RECOGNIZING MALL SPACE REVENUES AND BUS ADVERTISING RENTALS; APPROPRIATING FROM THE SEVENTH PENNY FUND TWO THOUSAND ($2,000.00) DOLLARS FOR RIO GRANDE IMPROVEMENTS AND FIFTEEN THOUSAND ($15,000.00) DOLLARS FOR ~ALL DE- SIGN WORK; ~ND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ENACTMENT WHEREAS, in order to recognize excess appropriated debt service monies and revenues in the Seventh Benny Sales Tax Fund, as well as unanticipated revenues, and to appropriate monies for Rio Grande Property improvements and mall design cost, the City Council must recognize these revenues and authorize these expenditures by emergency ordinance to insure that the approval is effective before the end of the fiscal year, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That revenues be recognized in the Seventh Penny Sales Tax Fund and expenditures therefrom be made as follows: Seventh Penny Sales Tax Fund Transfer excess appropriated debt service from Sales Tax Bonded Debt Reserve Fund Transfer excess appropriated debt reserve from 1973 Sales Tax Revenue Bonds Revenues from Mall Space Rentals Revenues from Bus Advertising Rentals Rio Grand Property Improvements (road base) Mall Design Unappropriated Surplus Revenues Expenditures $ 7,439.00 $ 9,910.00 1,100.00 150.00 2,000.00 15,~00.00 1,599.00 Leaving Unappropriated Revenues of Thirty-Eight Thousand Nine Hundred And Two ($38,902.00) Dollars. ~ection 2 If any provision of this ordinance or the application thereof RECORD OF PROCEEDINGS 1 O0 Leaves to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be ~ven effect without the invalid provisions or applications, and to this end the provisions or appications of this ordinance are declared to be severable. Section 3 That it is hereby declared that an emergency exists requir- ing the immediate adoption of this ordinance inasmuch as all budget ordinances for the 1975 revenues or expenditures must be fully approved by the City's governing body before the end of this calendar year; that this ordinance be approved only by the unanimous vote of councilmen present or a vote of five councilmen, whichever is less; that this ordinance be passed at two meetings of council; that neither a public hearing nor first publication be required; that this ordinance be published within ten (10) days after final passage, and that it take effect upon final passage.
