AN ORDINANCE AMENDING THE ASPEN ZONING CODE BY THE ADDITION
OF SUBSECTION (bb) TO SECTION 24-3.1 SUCH AS TO PROVIDE FOR
THE DEFINITION OF COMMERCIAL BAKERY; WHICH DEFINITION PRO-
VIDES FOR PRODUCTION AND WHOLESALING OF BAKED GOODS BUT
PROHIBITS OVER THE COUNTER SALES THEREOF ON THE PREMISES
WHEREAS, the City Council has recently considered
and approved a zone code amendment designating as a permitted
use within the Service/Commercial/Industrial District the
establishment of commercial bakeries, and
WHEREAS, the Council feels to insure correct applic-
ation of that ordinance, that the code should be further amended
so as to define the term "commercial bakery",

THE CITY OF ASPEN, COLORADO:
Section 1
IT ORDAINED BY THE CITY COUNCIL OF
That the Municipal Code of the City of Aspen, Colorado,
is hereby amended by adding subsection (bb) to Section 24-3.1, which
said subsection reads as follows:
"(bb) Commercial Bakery: A bakery in which there is
permitted the production and/or wholesale sale of
baked goods, but where over-the-counter or other
retail dispensing of baked goods shall be prohibited."
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions or
applications of this ordinance are declared to be severable.

That a public hearing be held on this ordinance on

Ch~bers, Aspen City Hall, Aspen, Colorado, fifteen (15) days
prior to which hearing notice of the s~e shall be published
once in a newspaper of general circulation within the City.
