HomeMy WebLinkAboutordinance.council.005-76RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~- (Series of 1976) AN ORDINANCE MAKING A SERIES OF AMENDMENTS TO THE AREA AND BULK REQUIREMENTS OF THE ASPEN ZONING CODE, SECTION 24-3.4; AMENDMENTS ELIMINATE THE DISTINCTION BETWEEN SUBDIVIDED AND UNSUBDIVIDED LANDS IN CALCULATING MINIMUM LOT AREA, MINIMUM LOT AREA PER D¥~LLING UNIT, AND MINIMUM LOT WIDTH IN THE R-15, R-30, R-40 AND RR ZONE DISTRICTS; and WHICH AMENDMENTS ALSO ESTABLISH A UNIFORM MINIMUM LOT AREA FOR ALL STRUCTURES IN THE R/MF DISTRICT OF 6,000 SQUARE FEET; AND FURTHER AMEND THE R/MF DISTRICT REQUIREMENTS BY PROVIDING THAT MINIMUM LOT AREA FOR DUPLEX STRUCTURES IN THIS DISTRICT BE CALCULATED AS IT IS FOR MULTIFAMILY STRUCTURES WHEREAS, the Aspen City Council has been presented with a recommendation from the Planning and Zoning Commission to make a series of changes to the Area and Bulk Requirements of the Zoning Code, and wishes to adopt the same, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That 24-3.4 of the Municipal Code of the City of Aspen, Colorado, is hereby amended in the following manner: a. The deletion of the references in the "Area and Bulk Requirements" Chart (hereinafter referred to as "Chart") key to "Un-Unsubdivided Land" and "S-Subdivided Land." b. The deletion in the R-15 district requirements in the Chart of (1) "40,000 Un" in Minimum Lot Area, (2) "20,000 Un" in Minimum Lot Area per Dwelling Unit", and (3) "150 Un" in Minimum Lot Width. c. The deletion in the R-15 District r~quirements in the Chart of (1) "15,000 S" in the Minimum Lot Area per Dwelling Unit, (2) "10,000 S" in the Minimum Lot Area per Dwelling Unit, and (3) "75 S" in Minimum Lot Width; and the substitution therefore of "15,000", "10,000", and "75" respectively. The deletion in the R-30 district requirements in the Chart of (1) "40,000 Un" in Minimum Lot Area, (2) "20,000 Un" in Minimum Lot Area per Dwelling Unit, and (3) "150 Un"in Minimum Lot Width. e. ?he deletion in the R-30 district requirements in the Chart of (1) "30,000 S" in the Minimum Lot Area, (2)"15,000 S" in the Minimum Lot Area per Dwelling Unit, and (3) "100 S" in Minimum Lot Width; and the substitution therefore of'~0,000", "15,000",and "100" respectively. f. The deletion in the R-40 district requirements in the Chart of (1) "~0,000 Un" in the Minimum Lot Area, (2) "40,000 Un" in the minimum Lot Area per Dwelling Unit", and "200 Un" in the Minimum Lot Width. g. The deletion in the R-40 district requirements in the Chart of (1) "40,000 S" in the Minimum Lot Area, (2) "20,000 S" in Minimum Lot Area per Dwelling Unit, and (3) "150S" in Minimum Lot Width; and the substitution therefore of "40,000", "20,000", and "150" respectively. h. The deletion in the RR district requirements in the Chart of "200 S" in the Minimum Lot Width and sub- stitution therefore of "200." i. ?he deletion in the R/MF Minimum Lot Area require- ments of "6~00 SF'~ "9,000 Dup", "6,000 MF", and "6,000 Bd Hs", and substitution therefore of "6,000". j. The deletion in the R/MF Minimum Lot Area per Dwelling Unit requirements of "3,000 Dup", and substitution therefore of "all others." Section 2 If any provision of this ordinance or the application there- of to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance -2- RECORD OF PROCEEDINGS 100 Leaves which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. Section 3 That a public hearing on this ordinance be held on ~~ /~ , 1976, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, fifteen (15) days prior to which hearing public notice of the same shall be published once in a newspaper of general circulation within the City.
