AN ORDINANCE ESTABLISHING A MALL CONSTRUCTION FUND AND TRANSFERRING
TO AND APPROPRIATING FROM SUCH FUND THE AMOUNT OF SIX HUNDRED THOUSAND
($600,000.00) DOLLARS FROM TRE 7TH PENNY SALES TAX BOND PROCEEDS
WHEREAS, the city Council, in anticipation of the con-
struction of improvements to the Aspen Pedestrian Mall and bonding
of 7th Penny Sales Tax Revenues to fund such improvements, wishes
to establish the Mall Construction Fund and appropriate therefrom
moneys necessary to proceed with construction,
~OW, CHEREFORE, 3E IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That there be established a Mall Construction Fund to
which there shall be transferred any and all proceeds from the 7th
Penny Sales Tax Bonds soon to be issued and from which fund there
shall be appropriated Six Hundred Thousand ($600,000.00) Dollars
capital improvements to the Aspen Pedestrian Mall, as follows:

Section 2
If any provision of this ordinance or the application there-
of to any person or circumstance is held invalid, such invalidity
shall not affect other provisions or applications of the ordinance
which can be given effect without the invalid provisions or applica-
tions, and to this end the provisions or applications of this
ordinance are declared to be severable.

A public hearing on this ordinance shall be held on the
