Z ANC 3£ (Series o£ 1976) AN ORDINANCE APPROPRIATING $29,000.00 FROM PARK DEDICATION FEES FOR PUBLIC TOILETS FOR WAGNER PARK ($16,000.00) and the CONSTRUCTION OF A CHILDRENS' PARK NEAR THE MALL ($13,000.00); AND FURTHER APPROPRIATING FROM THE SIXTH PENNY SALES TAX FUND $16,900.00 FOR STREET FURNISHINGS AND $20,000.00 FOR LANDSCAPING WHEREAS, the City Manager has advised the City Council that there are available unappropriated revenues in the City's Open Space Fund and the Council wishes to appropriate monies from the fund for various park and open space purposes, ~OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That there be appropriated the amount of Twenty-~ine Thousand following manner: Park Dedication Fee Fund Unappropriated Park Dedication Fees Public Toilets (Wagner Park) Childrens' Park (Mall) from the Park Dedication Fee Fund ($29,000.00) Dollars in the Leaving unappropriated revenues in the Park Dedication Fee Fund the amount of $83,287.00 Section 2 Appropriation Revenues Expenditures $ 29,000.00 $ 16,000.00 13,000.00 $ 29,000.00 $ 29,000.00 in ~'hat there be appropriated from the Sixth Penny Sales Tax Fund the amount of Thirty-Six Thousand Nine Hundred ($36,900.00) Dollars in the following manner: Sixth Penny Sales Tax Fund Unappropriated 6th Penny Sales Tax Revenues Street Furnishings etc.) Landscaping (benches, Appropriation Revenues Expenditures $ 36,900.00 bridges, $ 36,900.00 16,900.00 20,000.00 $ 36,900.00 RECORD OF PROCEEDINGS 100 Leaves Leaving unappropriated revenues in the Si~h Penny Sales Tax Fund in the amount of $102,048.00 Section 3 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable.
