HomeMy WebLinkAboutordinance.council.044-76RECORD OF PROCEEDINGS 100 Leaves ORDINANCE #44 (Series of 1976) AN ORDINANCE A~NDING ORDINANCE NO. 30, SERIES OF 1976, SO AS TO ESTABLISH NEW ENERGY CHARGES FOR ELECTRICAL SERVICE WITHIN THE CITY; MORE SPECIFICALLY, ESTABLISHING ENERGY CHARGES FOR COMMERCIAL, RESIDENTIAL AND ALL ELECTRIC USAGE OF $.0274 (PER KWH), $.0249 (PER KWH) AND $.0174 (PER KWH), RESPECTIVELY WHEREAS, Series of 1976, did owned utility, and WHEREA~ 30, Series of 1976, the City Council, in its Ordinance No. 30, establish new electric rates for the City subsequent to adoption of said Ordinance No. negotiations with the Public Service Company have reguired that the energy charges established in Ordinance No. 30 be amended, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 electricity an energy charge schedule: That from and after the effective date of the ordinance the Energy Charges established in Ordinance No. 30, Series of 1976, be and hereby are repealed, and that there shall be imposed on all electricity customers of the City of Aspen for retail sales of calculated according to the following Energy Charge (a) Commercial (per kilowatt hour) $ .0274 (b) Residential (per kilowatt hour). .0249 (c) All-Electric (per kilowatt hour) .0174 PROVIDED that such all-electric rate shall be increased by $.0025 kilowatt hour increments on each of the next three (3) anniversaries of the effective date of this ordinance; RECORD OF PROCEEDINGS 100 Leaves PROVIDED FURTHER that all-electric users having established new all-electric services from and after July 1, 1976, shall be immediately assessed the rate of $.0249 kilowatt hour for electricity supplied. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. Section 3 A public hearing on this ordinance shall be held on the 23rd day of August, 1976, at 5:00 p.m. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
