AN ORDINANCE A~ENDING SECTION 2-19 OF THE ASPEN
MUNICIPAL CODE, WHICH AMENDMENT ENLARGES THE MEM-
BERSHIP OF THE ASPEN BOARD OF ADJUSTMENT SO AS TO
PERMIT THE APPOINTMENT OF TWO ALTERNATE MEMBERS
WITH VOTING POWER ONLY IN THE ABSENCE OF REGULAR
MEMBERS OF THE BOARD
WHEREAS, the City Council is advised that providing
for the appointment of alternate members to the Board of Adjust-
ment will facilitate the proceedings of said Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Section 2-19 of the Municipal Code of the City
of Aspen, Colorado, is hereby amended to read as follows:
Sec. 2-19 Composition; Term
The board of adjustment shall consist of five
(5) regular and two (2) alternate members who
shall serve for a term of four (4) years (although
there shall be no restraint upon the number of terms
any member may serve). Alternates shall vote only
in the absence of a regular member, or members,
and when appointed, alternates shall be designated
as the first or the second alternate and shall act
for absent members according to their priority
(that is, the first alternate shall fill the first
vacancy and both alternates shall vote only in the
absence of two regular members of the board).
Section 2
If any provision of this ordinance or the applica-
tion thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid pro-
visions or applications, and to this end the provisions or appli-
cations of this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held
on the ~. day of ~ , 1976, in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
