(Series of 1976) AN ORDINANCE AMENDING SECTION 13-87 OF THE ASPEN MUNICIPAL CODE SO AS TO PERMIT THOSE REPORTING LOST PROPERTY TO THE ASPEN POLICE DEPARTMENT TO RECOVER POSSESSION OF THE PROPERTY IF NOT CLAIMED BY THE OWNERS PRIOR TO PUBLIC SALE, OR WITHIN 60 DAYS OF REPORTING THE FIND, %[HICHEVER FIRST OCCURS WHEREAS, The City Council is of the opinion that permitting those who find property to recover possession of it under certain circumstances will encourage the reporting of lost items. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 13-87(h) of the Aspen Municipal Code be repealed and re-enacted to read as follows: (h) Any person who has found lost property may, if the same shall not be claimed by its owner, recover possession of the same prior to any public sale of the property as hereinabove provided, or after 60 days of reporting the finding of the property to the police department, whichever first occurs. Section 2 That the Municipal Code of the city of Aspen, Colorado, is hereby amended by adding a subsection to Section 13-87, which said subsection reads as follows: (i) The owner, or other person having the right to possession, of any item of lost or confiscated property sold at any public sale conducted in accordance or substantially in accordance with the provisions of this division shall be barred from asserting any claim against the city or against the proceeds held by the City, from and after the date of the sale, except RECORD OF PROCEEDINGS 100 Leaves to the extent provided in subsection (e) with respect to the proceeds of a special sale claimed within thirty (30) days thereof. Section 3 If any provision of this ordinance or the appli- cation thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applica- tions of the ordinance which can be given effect without the invalid provision or application, and to this end the pro- visions of this ordinance are declared to be severable.
