(Series of 1976) AN ORDINANCE AMENDING THE PROVISIONS OF ORDINANCE NO. 8, SERIES OF 1975, SUCH AS TO REDUCE THE NUMBER OF MEMBERS OF THE ASPEN MALL COMMISSION TO EIGHT; AND FURTHER PROVIDING THAT SUCH REDUCTION SHALL OCCUR ON THE RESIGNATION, TE~4INATION, OR ON EXPIRATION OF THE TERMS OF EXISTING MEMBERS WHEREAS, the Aspen City Council has received a memorandum from the Mal 1 Commission recommending that the member- ship of the Commission be reduced from its present ten (10) members to eight (8), and WHEREAS, the Commission has recommended that the reduction in number be accomplished through the resignation, termination, or lapse of terms of existing members, and the City Council feels this approach is appropriate, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 3(a) of Ordinance No. 8, Series of 1975, be and hereby is repealed and re-enacted to read as follows: (a) The Mall Commission shall consist of eight (8) members, at least four (4) of which shall be owners or lessees of commercial properties abutting the pedestrian mall, as it shall exist at any given time. Section 2 That the reduction in the Commission membership shall be accomplished by the resignation, termination, or expiration of the terms of members presently sitting; provided that once the membership has been reduced to eight, all new appointments shall be made so as to conform to the requirements of Section 1 above. RECORD OF PROCEEDINGS 100 Leaves ~ection 3 Ail provisions of Ordinance No. 5, Series of 1975, to the extent not inconsistent herewith, shall remain in full force and effect, and nothing herein shall be construed to constitute an extension of the term of the Commission beyond that period described in Section 2 of said Ordinance No. 8, Series of 1975. Section 4 Zf any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. Section 5 A public hearing on this ordinance shall be held on the __ day of , 1976, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
