HomeMy WebLinkAboutordinance.council.054-76RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1976) AN ORDINANCE AMENDING SECTION 4-2 OF THE ASPEN MUNICIPAL CODE SO AS TO INCLUDE WITHIN THE CATEGORY OF CLASS "A" LIQUOR OPERATORS THOSE OPERATING TAVERNS, IN ADDITION TO HOTEL/ RESTAURANT LICENSEES ~'~EREAS, the State of Colorado in recent legisla- tion created a new type of liquor license called a tavern license, and the Municipal Code must be amended categorizing this license so as to determine an appropriate occupation tax to be assessed by the City, and WHEREAS, the City Council has concluded that tavern license operators should be classified as Class "A" Operators inasmuch as the tavern license is a three-way liquor license comparable to a hotel/restaurant license (also a Class "A"), NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Sec. 4-2 of the Municipal Code of the City of Aspen, Colorado, is hereby amended by the repeal and re-enact- ment of the second paragraph of said section to read as follows: Class "A" Operators. All operators who are licensed to sell beer, wine and spirituous liquors for consumption on the premises either as hotels or restaurants or taverns shall be Class "A" operators. Section 2 if any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the in- valid provision or application, and to this end the provisions RECORD OF PROCEEDINGS 100 Leaves of this ordinance are declared to be severable.
