HomeMy WebLinkAboutordinance.council.067-76RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~7 (Series of 1976) AN ORDINANCE AMENDING SECTION 7-141 OF THE ASPEN MUNICIPAL CODE BY THE ADDITION OF SUBSECTION (f) TO SECTION 3207 OF THE UNIFORM BUILDING CODE; WHICH SAID SUBSECTION (f) REQUIRES THAT ALL COMMERCIAL BUILDINGS ABUTTING PUBLIC PROPERTY BE FURNISHED WITH (AT A MINIMUM) HEATED DOWNSPOUTS SUFFICIENT TO PREVENT THE ACCUMMULATION OF ICE OVER PUBLIC RIGHTS OF WAY AND TO CHANNEL ROOF RUN OFF WATER TO GROUND LEVEL WHEREAS, the City Council is advised that commercial buildings lacking roof drainage systems are creating hazardous conditions on abutting rights of way because of artificial accummulations (both hanging and surface) of ice dangerous to pedestrians. Section 1 That Section 7-141 of the Aspen Municipal Code is hereby amended by the addition of subsection (q) of said section, which said subsection reads as follows: (q) The Uniform Building Code, 1973 Edition, is hereby amended by the addition of subsection (f) to Section 3207 which said subsection shall read as follows: From and after the effective date of this amendment, all commercial buildings abutting public property which, because existing at the time of the adoption of this code are exempt from the requirements of this Section 3207, shall, at a minimum, provide exterior downspouts (with heating devices) sufficient to prevent the accummulation of ice over adjacent public rights-of-way and to channel roof run off waters to ground level. RECORD OF PROCEEDINGS 100 Leaves Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid pro- vision or application, and to this end the provisions of this ordinance are declared to be severable. Section 3 A public hearing on the ordinance shall be held on , 1976, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
