HomeMy WebLinkAboutordinance.council.074-76RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 74 (Series of 1976) AN ORDINANCE AMENDING THE MUNICIPAL CODE BY THE ADDITION OF SECTION 5-7 THERETO AUTHORIZING THE IMPOUNDMENT OF CATS WHICH ARE ABANDONED OR WHICH CONSTITUTE A NUISANCE; FURTHER AUTHORIZING THEIR DESTRUCTION IF NOT CLAIMED WITHIN FIVE DAYS, AND IMPOSING AN IMPOUND FEE OF $3.00 PER DAY FOR EACH DAY HELD PURSUANT HERETO WHEREAS, the City Council is of the opinion that some regulation of cats within the City is necessary and appropriate at this time, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the Municipal Code of the City of Aspen, Colorado, is hereby amended by adding a section which said section reads as follows: Sec. 5-9 Regulation of Cats Stray cats which are abandoned or which constitute a nuisance and whose owners are unknown shall be impounded for a period not execeeding five days at which time they may be destroyed or given away at the election of any city animal warden. Seriously injured or diseased cats may be destroyed immediately. Notice of cats impounded pursuant to this section shall be posted in three (3) public places in the municipality. There shall be paid, by any owner claiming any impounded cat, Three ($3.00) Dollars for each day said animal was held, plus any additional charges for veterinary services rendered during impoundment. RECORD OF PROCEEDINGS 100 Leaves Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 3 A public hearing on the ordinance shall be held on ~ /3 , 1976, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
