ORDINANCE NO. 2
(Series of 1977)
AN ORDINANCE AUTHORIZING THE EXTENSION OF WATER
SERVICES TO THE PROPOSED MIDLAND PARK SUBDIVISION
AND DOING SO PURSUANT TO THE REQUIREMENTS OF SECTION
11.3 OF THE ASPEN HOME RULE CHARTER
WHEREAS, Section 11.3 of the Aspen Home Rule Charter
does provide that if the City Council desires to extend municipal
water utility transmission lines beyond city boundaries, it must
so do by ordinance, and
WHEREAS, the City Council has determined that the
extension of water service to the County-owned Midland Park Sub-
division is appropriate and wishes to authorize the same,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That the City Council does hereby authorize the
service of water from the City-owned utility to the following
described properties (constituting the Midland Park Subdivision)
located in Pitkin County, Colorado, to-wit:
Tract No. 1
A tract of land situated in the South one-half of
the Southeast Quarter of Section 7, Township 10
South, Range 84 West of the Sixth Principal Meridian,
Pitkin County, Colorado, being all that portion of
the Mascotte Lode mininq claim, U.S.M.S. 5867, lying
easterly of the Anthony Berumen Annexation to the City
of Aspen and northerly of the Riverside Annexation to
the City of Aspen and all that portion of the "99"
Lode mining claim, U.S.M.S. 6899, lying easterly
of the Riverside Annexation to the City of Aspen
and easterly of the Aspen Hills Annexation to the
City of Aspen, more fully described as follows:
Beginning at Corner No. 5 of said Mascotte Lode, a
granite stone;

of the Silver Brick Lode, U.S.M.S. 3952, to Corner

Line 4-3 of said Mascotte Lode;
Thence S 44°48'03" E 140.74 feet along Line 4-3 of
said Mascotte Lode to Corner No. 3 of said Mascotte
Lode, a granite stone;

said "99" Lode to the Southeast Corner of the
Aspen Hills Annexation to the City of Aspen;

Corner No. 8 of said Riverside Annexation, said
Corner No. 8 being also on Line 1-5 of said
Mascotte Lode and on Line 1-2 of the Anthony Berumen
Annexation to the City of Aspen;
Thence N 45024'29'' E 509.78 feet along said Line 1-5
of said Mascotte Lode and along said Line 1-2 of
said Anthony Berumen Annexation to Corner No. 2 of
said Anthon~ Berumen Annexation;
Thence N 45u24'29" E 523.52 feet along said Line 1-5
of said Mascotte Lode to the point of beginning;
containing 10.855 acres, more or less.
Tract No. 2
That parcel recently disconnected from the City of
Aspen and described in Ordinance No. 6, Series of 1977.
Tract No. 3
And the northerly 16 feet of the following described
tract:
A parcel of land situated in Section 7, Township 10
South, Range 84 West of the 6th P.M., City of Aspen,
Colorado, being situated in the Riverside Placer,
U.S.M.S. 3905 and being more fully described as
follows:
Beginning at Corner No. 3 of the "99" Lode, U.S.M.S.
6899, a B.L.M. Brass Cap being also a point on the
north line of said Riverside Placer;
Thence S 00o15'25'' W 35.00 feet; thence N 89o44'35'' W
251.42 feet to a point on the Southeasterly extension
of the east line of thatoPrOperty described in Book 257
at PaGe 327; thence N 06 23'00" W 35.24 feet along said
east iine and extension thereof to the Northeast corner
of that property ~escribed in said Book 257 at Page 377;
Thence S 89 44'35' E 255.50 feet along the north line
of said Riverside Placer to the point of beginning,
containing 0.204 acres, more or less.

Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this
ordinance are declared to be severable.
Section 3
A public hearing on the ordinance shall be held on

Council Chambers, Aspen City Hall, Aspen, Colorado.
