ORDINANCE NO. 5
(Series of 1977)
AN ORDINANCE RATIFYING A CERTAIN TERMINATION
AGREEMENT BETWEEN THE CITY OF ASPEN AND MOUNTAIN
BELL COMPANY PROVIDING FOR PBX SWITCHING EQUIP-
MENT FOR THREE YEARS IN THE SAME LOCATION AT
A CONTRACT TERMINATION LIABILITY OF $5,400.00
(WHICH AMOUNT REDUCES 1/36 FOR EACH MONTH OF
SERVICE), ALL AS MORE SPECIFICALLY PROVIDED
HEREIN
WHEREAS, there has been tendered to the City Council
a certain termination agreement between the City and Mountain
Bell Company providing for PBX switching equipment for three
years in the same location, which agreement the Council wishes
to approve, and
WHEREAS, Section 10.3 of the Aspen Home Rule Charter
authorizes the City to execute such agreements but requires
that each such agreement and the terms thereof be approved
by an ordinance duly enacted by the City,
NOW, THEREFORE, ~E IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That it does ratify and approve that certain Termina-
tion Agreement for PBX Systems between the City of Aspen and
Mountain Bell Company attached hereto as Exhibit A and incorporated
by this reference, and authorizes Stacy Standley III, Mayor,
after the effective date hereof, to execute the same on behalf
of the City of Aspen.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid pro-
vision or application, and to this end the provisions of this

ordinance are declared to be severable.
Section 3
A public hearing on the ordinance shall be held on

City Council Chambers, Aspen City Hall, Aspen, Colorado.
