HomeMy WebLinkAboutordinance.council.026-77RECORD OF PROCEEDINGS 100 Leaves (Series of 1977) AN ORDINANCE RATIFYING AN AGREEMENT BETWEEN THE CITY OF ASPEN AND AIRPORT AUTO CENTER AND DILLINGHAM V.i~. & TOWING SERVICE, INC. ("CONTRACTORS"), PROVIDING FOR TOWING AND STORAGE SERVICES TO THE CITY FOR A PERIOD OF ONE YEAR; %{HICH AGREEMENT INCORPORATES A SCHEDULE OF CHARGES FOR SUCH SERVICES; REQUIRES THE LISTING OF CERTAIN INFORMATION ON VEHICLES TOWED AT THE TIME OF BILLING; PERMITS THE CITY TO CANCEL A TOW AT ANY TIME BEFORE A VEHICLE IS ATTACHED TO A TOW TRUCK; REQUIRES THE CONTRACTORS TO INDEMNIFY THE CITY AGAINST CLAIMS FOR LOSS AND INJURY RESULTING FROM SERVICES CONTRACTED FOR; AND FURTHER REQUIRES THE CONTRACTORS TO PROVIDE INSURANCE COVERAGE, ALL AS MORE SPECIFICALLY PROVIDED THEREIN WHEREAS, there has been submitted to the City Council a proposed agreement for towing and storage services to the City, the terms of which the Council finds appropriate, and WHEREAS, Section 9.13(b) of the Home Rule Charter requires that all contracts requiring payments beyond the end of this fiscal year must be approved by ordinance, i~OW, ~HEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That it does ratify and approve the towing and storage agreement between the City of Aspen and Contractors attached hereto and incorporated by this reference; and does further authorize the Mayor on the effective date of this ordinance, to execute said agreement on behalf of the City of Aspen. Section 2 if any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable.
