AN ORDINANCE AMENDING SEC.2~3-7(e)(2) OF THE ZONING
CODE OF THE CITY OF ASPEN WHICH AMENDMENT SPECIFIES
WHEN BASEMENTS, SUB-BASEMENTS, PARKING AND AREAS
DEDICATED TO MECHANICAL OPERATION OF BUILDINGS IS
INCLUDED IN EXTERNAL FLOOR AREA RATION CALCULATIONS
WHEREAS, the Aspen City Council has been presented a
recommendation from the Planning and Zoning Commission to amend
Sec.24.~7(e) (2) of the Zoning Code, and
WHEREAS, the City Council desires to amend said
section for the benefit of the City of Aspen,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Sec.2~(e) (2) of the Zoning Code of the City
of Aspen is hereby amended in the following manner:
"For purposes of calculated external floor area
ratio, there shall be included basement and
sub-basement areas in CC and C1 districts except
any such basement or sub-basement area devoted
to parking. In districts other than CC and C1
subgrade and parking areas shall be excluded from
external floor area ratio calculations. Areas
dedicated to mechanical operation of buildings
shall be excluded from external floor area ratio
calculations in all districts."
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid

provisions or applications, and to this end the provisions
or applications of this ordinance are declared to be severable.
Section 3
That a public hearing on this ordinance be held on
June 13 , 1977, at 5:00 P.M. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED published as provided
by law by the City Council of the City of Aspen, Colorado, at
its regular meeting held at the City of Aspen on the 23rd
day of May
