ORDINANCE NO. 42
(Series of 1977)
AN ORDINANCE APPROVING THE TERMS AND CONDITIONS
OF AN INSTALLMENT PURCHASE AGREEMENT FOR ONE 1977
PITMAN MODEL HL857 HYDRA-LIFT BETWEEN THE CITY OF
ASPEN AND ELDER/QUINN & MCGILL, INC. WHICH AGREEMENT
IS FOR A TERM OF TWELVE (12) MONTHS AND PROVIDES
FOR MONTHLY PAYMENTS OF $914.57.
WHEREAS, the City Council is required, by reason of
Section 10.8 of the home rule charter, to ratify all long term
installment purchase agreements by ordinance, and its wishes
to do so with respect to an outstanding agreement between the
City of Aspen and Elder/Quinn & McGill, Inc.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That it does hereby ratify and approve that installment
purchase agreement between the City of Aspen and Elder/Quinn & McGill,
Inc. providing for the purchase of a 1977 Pitman Model HL857 Hydra-lift
Serial #3857-1977-0097 under the following terms and conditions:
Term of installment purchase agreement: 12 months
Monthly payments: $914.57
and such.other common contract provisions as are specified in
the agreement itself (on file in the office of the Director of
Finance of the City of Aspen).
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this
ordinance are declared to be severable.
RECORD OF PROCEEDINGS
Section 3
A public hearing on the ordinance shall be held on

City Council Chambers, Aspen City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED published as provided
by law by the City Council of the City of Aspen, Colorado, at
