HomeMy WebLinkAboutordinance.council.045-77RECORD OF PROCEEDINGS 100 Leaves (Series of 1977) AN ORDINANCE AMENDING SECTION 7-141 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN (AMENDMENTS TO UNIFORM BUILDING CODE) BY THE ADDITION OF SUBSECTION (v) WHICH SUBSECTION PROVIDES FOR EMERGENCY LIGHTING SYSTEMS FOR CERTAIN SUBGRADE OCCUPANCIES WHEREAS, the City Council of the City of Aspen has detor~ined that continued use of certain cellars without emergency lighting systems is dangerous to life, and WHEREAS, the City Council of the City of Aspen, colorado, desires to amend Section 7-141 of the Municipal code of the City of Aspen, NOW, THEREFORE, BE IT ORDAINED BY THE CITY cOUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 ~hat Section 7-141 of the Municipal code of the City of Aspen is hereby amended by the addition of subsection (v) which shall read as follows: 7-141(v) The uniform Building code, 1976 edition, is hereby amended by the addition of subsection (v) to Section 3311, which subsection shall read as follows: Sec. 3312(d) Below Grade Lighting 1. In any group A, B2, I or R1 occupancy every cellar shall be provided with emergency lighting for means of egress. 2. The emergency lighting system shall be so con- structed as to provide the required illumination automatically in the event of any interruption of normal lighting, such as failure of electric power or opening of a circuit breaker or fuse. Electric battery operated emergency lights shall use only reliable types of storage batteries, provided RECORD OF PROCEEDINGS 100 Leaves with suitable facilities for maintenance in properly charged condition. Dry batteries shall not be used to satisfy these requirements. Electric storage batteries used in such lights or units shall be approved for their intended use and shall comply with the National Electric Code. The emergency lighting system shall be capable of repeated automatic operation without manual inter- vention. There shall be no appreciable interruption of illumination during the change over from normal to emergency operation. 3. The emergency lighting system shall be capable of illuminating the means of egress at all points including angles and intersections of corridors and passage- ~Tays, stairways, landings of stairs, and exit doors to values of not less than 1.9 foot candle measured at the floor for a period of one hour; and shall be so arranged that the failure of any single lighting unit, such as the burning out of an electric bulb, will not leave any area in darkness. 4. Installation of emergency lighting systems required herein shall be made on or before November 15, 1977. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Hauter City Clerk -3- RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 44 (Series of 1977) AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF $29,000.00 FROM UNAPPROPRIATED PARK DEDICATION FEES FOR RENOVATING WEST END DITCHES WHEREAS, the City Manager has certified that there are available from unappropriated revenues in the park dedication fee fund, and WHEREAS, by virtue of Section 9.12(a) of the Home Rule Charter, the City Council by ordinance may make supplemental appropriations, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That $29,000 .00 be appropriated from the park dedication fee fund for renovating west end ditches. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 3 A public hearing on this ordinance shall be held on , 1977, at 1:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
