ORDINANCE NO. 52
(Series of 1977)
AN ORDINANCE AMENDING CHAPTER 23 OF THE
MUNICIPAL CODE BY THE ADDITION OF SEC. 23-67
WHICH SECTION PROVIDES THAT THE CITY COUNCIL
MAY REDUCE PLANT INVESTMENT FEES FOR MODERATE
INCOME EMPLOYEE HOUSING PROJECTS LOCATED OUT-
SIDE THE CITY LIMITS TO THE AMOUNT WHICH WOULD
HAVE BEEN CHARGED HAD THE PROJECT BEEN LOCATED
WITHIN THE CITY LIMITS
WHEREAS, the City Council wishes to amend Chapter 23
by the addition of Section 23-67 to the Municipal Code of
the City of Aspen, and
WHEREAS, the City Council wishes to amend said
Chapter 23 for the benefit of the City of Aspen, Colorado,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
?hat the Municipal Code of the City of Aspen,
Colorado, is hereby amended by the addition of Section 23-67
which section reads as follows:
Sec. 23-67 Employee Housing Projects Outside the
Limits of the City of Aspen
Whenever the City Council shall have determined
that a housing project located outside the limits
of the City of Aspen constitutes a bona fide moderate
income employee housing development and wishes to
subsidize its construction, the Council may reduce
the plant investment fee to that which would have
been charged had the project been located within the
City limits. Applicants for such reductions must
demonstrate that, if granted, the reduction will be
passed on to purchasers or tenants.
Section 2
If any provision of this ordinance or the application

thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this
ordinance are declared to be severable.
Section 3
A public hearing on the ordinance shall be held on
Council Chambers, Aspen City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED published as provided by
law by the City Council of the City of Aspen, Colorado, at its
