HomeMy WebLinkAboutordinance.council.055-77RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. %~- (Series of 1977) AN ORDINANCE APPROVING A WATER MAIN EXTENSION OUTSIDE THE ASPEN CITY LIMITS AND LOCATED ON THE ROADWAY KNO~ AS QUEEN STREET WHEREAS, Section 11.3 of the Home Rule Charter of the City of Aspen provides that if the Council desires to extend the municipal water utility transmission lines beyond city boundaries, it shall do so by ordinance; and WHEREAS, the City Council desires to approve a water main extension outside the city limits within the roadway known as Queen Street; and WHEREAS, the Pitkin County Planning and Zoning Commission has approved the extension pursuant to Resolution No. 13, Series of 1973, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the water main extension within the roadway known as Queen Street is hereby approved. The extension will service the parcel of land owned by Marcella DeCray and more specifically described as follows: That portion of Tract 40 in the East Aspen Addition to the City of Aspen, Pitkin County, Colorado, described as follows: Beginning at a point on the Northerly bank of the Roaring Fork River, said point being arbitrarily determined as the law water mark, whence Corner NO. 11 of said East Aspen Addition bears North 0°14' East 629.36 feet; thence North 13046' East 76.35 feet; thence North 73°29' West 158.70 feet; thence South 13046' West 112.56 feet to said low water mark on the Northerly bank of the Roaring Fork River; thence Easterly along said low water mark on Northerly bank of the Roaring Fork River to the point of beginning. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity RECORD OF PROCEEDINGS 1 O0 Leaves shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or appli- cation, and to this end the provisions of this ordinance are declared to be severable. Section 3 A public hearing on the ordinance shall be held on the ~ day of ~ , 1977, at 1:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
