AN ORDINANCE AMENDING Sec. 24-3.2 OF THE MUNICIPAL
CODE OF THE CITY OF ASPEN ADDING AS A CONDITIONAL
USE IN THE C-1 DISTRICT, CERTAIN LIMITED FOOD
SERVICES
WHEREAS, the Aspen City Council has been presented with
a recommendation from the Planning and Zoning Commission to
amend Section 24-3.2 of the Municipal Code, and
WHEREAS, the City Council wishes to adopt the same for the
benefit of the City of Aspen,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
Section 24-3.2 is hereby amended by the deletion of the
word "none" and the addition of the following conditional
use in the C-1 District:
Coffee shop or food service intended as a non-
tourist oriented sit-down facility with a limited
fare of specialty items, to be served as accompani-
ments to such activities as reading, playing chess,
or other passive activity, and provided that the
operation:
(1) has no kitchen;
(2) has no food preparation other than warming
on the premises;
has no liquor service on the premises.

Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this

Section 3
That a public hearing be held on this ordinance on

Aspen City Hall, Aspen, Colorado, 15 days prior to which hearing
notice of the same shall be published once in a newspaper of
general circulation within the City of Aspen.
