(Series of 1978)
AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION
OF $34,114.00 FROM EXCESS ELECTRIC FUND REVENUES
FOR THE 1978 PAYMENT ON PROPERTY PURCHASED FOR
ELECTRIC DEPARTMENT USE AND APPROVING THE TERMS
OF THE PURCHASE AGREEMENT FOR SUCH PROPERTY
WHEREAS, the City of Aspen may enter into long term
installment purchase contract to acquire land for governmental
and proprietary purposes; and
WHEREAS, the City Council wishes to purchase (for Electric
Department use) certain real property described as follows:
Lots 1, 2, 3, 4 and 5, Block 1,
Lakeview Addition to the City and Townsite of Aspen,
Pitkin County, Colorado; and
WHEREAS, the terms of such purchase are three yearly install-
nLents totaling $117,250.00 as more fully set forth in the deed
of trust; and
WHEREAS, the 1978 payment for such property is $34,114.00;
and
WHEREAS, the City Manager has certified that $34,114.00
is available for appropriation from revenues in the Electric
Fund in excess of those estimated in the budget,
~OW, ?HEREFORE, 3E IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
?he City Council of the City of Aspen hereby approves
the agreement to purchase the above-described property and
the terms thereof.
Section 2
$34,114.00 of excess revenues in the Electric Fund is

hereby appropriated for the 1978 payment for such property.
Section 3
if any provision of this ordinance or the application
thereof to any person or circ~stance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of
this ordinance are declared to be severable.
Section 4
A public hearing on the ordinance shall be held on
City Council Ch~bers, Aspen City Hall, Aspen, Colorado.

regular meeting held at the City of Aspen on the~ day of
