ORDINANCE NO. 19
(Series of 1978)
AN ORDINANCE AMENDING SEC. 20-22 OF THE
MUNICIPAL CODE OF THE CITY OF ASPEN BY
(1) THE ADDITION OF (c) (5) WHICH PROVIDES
AN ADDITIONAL CRITERIA TO BE CONSIDERED
IN DETERMINING WHETHER APPROVAL WILL REDUCE
THE SUPPLY OF LOW AND ~DERATE INCO~ HOUSING
AND (2) THE ADDITION OF SUBSECTION (d)
WHICH REQUIRES THAT, IF SUBDIVISION APPROVAL IS
GRANTED, THE CONDOMINIUMS SHALL BE REGISTERED
WITH THE HOUSING AUTHORITY
WHEREAS, the city Council of the City of Aspen, Colorado,
desires to amend Section 20-22 of the Aspen Municipal Code
for the benefit of the City of Aspen,
i~OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
Sec. 20-22 is hereby amended by the addition of subsection
(c) (5) which provides as follows:
(c) (5) Evidence that the applicant has deed
restricted the property so that it may be sold
or leased only to persons who have been employed
in Pitkin County for at least 8 of the 12 months
immediately preceeding the sale or lease.
Section 2
Sec. 20-22 is hereby amended by the addition of subsection
(d) which provides as follows:
(d) If subdivision approval is granted, the
condominiums shall be registered with the Housing
Authority and all subsequent sales and lease
agreements shall be filed with the Housing
Authority.

Section 3
If any provision of this ordinance or the applications
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of
this ordinance are declared to be severable.
