HomeMy WebLinkAboutordinance.council.020-78RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 20 (Series of 1978) AN ORDINANCE EXTENDING THE MUNICIPAL WATER UTILITY TRANSMISSION LINES BEYOND CITY BOUNDARIES WHEP~AS, Section 11.3 of the Charter of the City of Aspen requires that if the Council desires to extend the municipal water utility transmission lines beyond City boundaries, it shall do so by ordinance; and ~EREAS, upon closing in accord with the terms and condi- tions of the agreement attached hereto and incorporated by reference, the city Council desires to extend the municipal water utility lines to the property described in Section 1 below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 ~hat the municipal water utility transmission lines may be extended upon closing in accord with the terms and conditions of the agreement attached hereto and incorporated by reference to the following described property beyond city boundaries: A tract of land in the SW¼SW¼ of Section 6, Town- ship 10 South, Range 84 West of the 6th Principal Meridian described as follows: Beginning at a point whence the Northwest Corner of the SW¼SW¼ of said Section bears North 21.1 feet; thence South 53008' ~;est 6.99 feet; thence South 33000' East 3.90 feet; thence South 46030' East 221.82 feet; thence South 47016' East 16.43 feet; thence South 186.22 feet; thence North 67005' West 195.43 feet to the West line of said Section 6; thence North 281.70 feet to the point of beginning, County of Pitkin, State of colorado. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications RECORD OF PROCEEDINGS 100 Leaves of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable.
