R E C O R D O F P R O C'E E D I N G S (Series of 1978) AN ORDINANCE AMENDING ORDINANCE NO. 6, SERIES OF 1978, WHICH ADOPTED BY REFERENCE THE 1977 EDITION OF THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES" WHEREAS, it is the desire of the City Council to amend Ordinance No. 6, Series of 1978, which adopted the 1977 edition of the Model Traffic Code for Colorado Municipalities for the benefit of the City of Aspen; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 2 of Ordinance No. 6, Series of 1978, is hereby amended by the addition of subsection (3) and sub- section (4) to read as follows: (3) Section 22-20. Model Traffic Code Section 22-20 is hereby amended by the adoption of a new section to read as follows: Whenever any police officer finds a vehicle, attended or unattended, standing within this municipality in such a manner as to constitute a violation of section 10-5, section 10-6 or section 11-1 of this code, or left unattended for a period of 24 hours or more and presumed to be abandoned under the conditions prescribed by 42-4-1102(2) and 42-4-1103(2) C.R.S. 1973, such officer shall require such vehicle to be removed or cause the same to be removed and placed in storage in a garage or other place of safety designated or maintained by this municipality, said removal and storage to be at the sole cost, risk and expense of the owner or person in charge of said vehicle, and said cost of removal and storage of said vehicle shall be paid by the owner or person in charge thereof prior to the release of said vehicle. (4) Section 25-5(c). Model Traffic Code Section 25-5(c) is hereby amended to read as follows: (c) Holidays. ~Vhere used in this ordinance or on official signs shall in addition to Sundays mean New Year's Day, ~lashington's Birthday, Memorial Day, Independence Day, Colorado Day, Labor Day, Veteran's Day, Thanksgiving Day, Christmas Day and such additional statutory holidays as may by ordinance be declared applicable. .,,,,,o~o;,o.~.~.~...~o..=..,,.. R E C O R D O F P R O C E E D I N G S Section 2 That Section 4 of Ordinance No. 6, Series of 1978, is hereby repealed and reenacted to read as follows: This ordinance shall apply to every street, alley, side- walk area, driveway, park, and to every other public way or public place or public parking area, either within or outside the corporate limits of this municipality, the use of which this municipality has jurisdiction and authority to regulate. The provisions of Section 5-1, 5-2, 6-1, 15-12, 20-6, 21-11, and 23-3 of the adopted Model Traffic Code respectively concerning reckless driving, careless driving, moving parked vehicles, unauthorized devices, limitations on backing, eluding officer and accident investigation shall apply not only to public places and ways but also throughout this municipality. Section 3 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 4 A public hearing on the ordinance shall be held on ~ /~ , 1978, at 5:00 P.~. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
