HomeMy WebLinkAboutordinance.council.050-78RECORD OF PROCEEDINGS ORDINANCE NO. ~ (Series of 1978) AN ORDINanCE RATIFYING AN AGREEMENT BETWEEN THE CITY OF ASPEN AND STEPHEN R. SCHUBERT ("CONTRACTOR"), PROVIDING FOR KENNEL SERVICES TO THE CITY FOR A PERIOD OF FIVE YEARS, WHICH AGREEMENT INCORPORATES A CONTRACT PRICE FOR SUCH SERVICES; REQUIRES THE CONTRACTOR TO INDEMNIFY THE CITY AGAINST CLAIMS FOR LOSS AND INJURY RESULTING FROM THE SERVICES CONTRACTED FOR; AND FURTHER REQUIRES THE CONTRACTOR TO PROVIDE INSURANCE COVERAGE, ALL AS MORE SPECIFICALLY PROVIDED THEREIN; AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ENACTMENT. WHEREAS, there has been submitted to the City Council a proposed agreement for kennel services to the City, the terms of which the Council finds appropriate, and WHEREAS, Section 9.13(b) of the Home Rule Charter requires that all contracts requiring payments beyond the end of the fiscal year must be approved by ordinance, and WHEREAS, the currant contract for kennel services expires December 31, 1978, the City Council is advised the provisions must be made for such services before the end of the calandar year, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL ~ OF THE CITY OF ASPEN, COLORADO: Section 1 That it does ratify and approve the kennel service agreement between the City of Aspen and Contractor attached hereto and incorporated by this reference; and does further authorize the Mayor on the effective date of this ordinance, to execute said agreement on behalf of the City of Aspen. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. RECORD OF PROCEEDINGS Section 3. That it hereby declared that an emergency exists requiring the immediate adoption of this ordinace inasmuch as the currant contract for kennel service expires December 31,1978 and provision must be made for such service by the City's governing body before the end of this calandar year: that this ordinance be approved only by the unanimous vote of councilmen present or a vote of five councilmen, whichever is less; that this ordinance be passed at two meetings of council; that neither a public hearing nor first publication be required; that this ordinance be published within Ten (10) days after final passage, and that it take effect upon final passage.
