(Series of 1978) AN ORDINANCE REDUCING PRIOR APPROPRIATIONS OF PARK DEDICATION FEE PROJECTS OF THE GENERAL FUND OF $22,109.00; AND TRANSFERING SAID ~{OUNT TO THE LAND FUND- UNAPPROPRIATED BALANCE; AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ENACTMENT. WHEREAS, the City Council is advised that certain appropriated expenditures will not be realized, and WHEREAS, Said funds should be transfered to the Land Fund- unappropriated balance, and be so before the end of the calander year. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. Upon the City Manager's certification that there are Park Dedication Fee Projects previously appropriated for which expenditures will not be realized, the City Council hereby reduces the following appropriations: Parks Department Ute Park Sprinklers Jenny Adair Park Improvements Little Cloud Park Improvements $ (4~501.00) (1,500.00) (1,500.00) $ 7,502.00 Recreation Department Iselin Concession Stand Equipment Teen Center Concession Machines Iselin Tennis Equipment Section 2. $(2,300.00) (10,000.00) (2,307.00) $ 14,607.00 The revenues in the Land Fund-unappropriated Balance are hereby increased in the amount of $22,109.00. Section 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. RECORD OF PROCEEDINGS Section 4 That it is hereby declared that an emergency exists requiring the immediate adaption of this ordinance inasmuch as all budget ordinances for 1978 revenues or expenditures must be fully approved by the City's governing body before the end of this calandar year: that this ordinance be approved only by the unanimous vote of councilmen present or a vote of five councilmen, whichever is less; that this ordinance be passed at two meetings of council; that neither a public hearing nor first publication be required; that this ordinance be published within Ten (10) days after final passage, and that it take effect upon final passage.
