AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION
IN THE AMOUNT OF $87,085.00 FROM THE PRIOR YEAR
UNAPPROPRIATED GENERAL FUND SURPLUS, APPROPRIATING
$4,700.00 FROM EXCESS 7TH PENNY SALES TAX REVENUES,
APPROPRIATING $41,700.00 FROM PRIOR YEAR UNAPPROPRIATED
SURPLUS WATER DEPARTMENT FUNDS, AND APPROPRIATING
$4,500.00 FROM UNAPPROPRIATED CURRENT YEAR REVENUES.

WHEREAS, the City Manager has certified that there
are available for appropriation revenues in excess of those
estimated in the budget, and
WHEREAS, by virtue of Section 9.12 of the Home Rule
Charter, the City Council may make supplemental appropriations,
and,
WHEREAS, the City Council is
revenues and expenditures must be
advised that certain
recognized and approved,
and be so before the end of the calandar year,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
Upon the City Manager's certification that there are
available for appropriation revenues in excess of those
estimated in the budget, the City Council hereby makes a
supplemental appropriation of Prior Year Unappropriated
General Fund Surplus in the amount of $87,085.00, of
Excess 7TH Penny Sales Tax Revenues in the amount of
$4,700.00, of Prior Year Unappropriated Surplus Water
Department Funds in the amount of $41,700.00 and of
Unappropriated Current Year Revenues on attached Exhibit "A"
in the amount of $4,500.00 for the purpose specified on
attached Exhibit "B".
Section 2.
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the
invalid provision or application, and to this end the

provisions of this ordinance are declared to be severable
Section 3.
That it is hereby declared that an emergency exists
requiring the immediate adoption of this ordinance inasmuch
as all budget ordinances for 1978 revenues or expenditures
must be fully approved by the City's governing body before
the end of this calendar year; that this ordinance be
approved only by the unanimous vote of councilmen present
or a vote of five councilmen, whichever is less; that this
ordinance be published within Ten (10) days after final
passage, and that it take effect upon final passage.
