HomeMy WebLinkAboutordinance.council.053-78RECORD OF PROCEEDINGS ORDINANCE NO.~ (Series of 1978) AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION IN THE PUBLIC TRANSIT ENTERPRISE FUND IN THE AMOUNT OF $115,500 FROM BUS SERVICE CONTRACT REVENUES IN EXCESS OF THOSE ESTIMATED IN THE BUDGET AND TRANSFERRING $52,000 FROM THE TRANSPORTATION FUND TO THE PUBLIC TRANSIT ENTERPRISE FUND; APPROPRIATE EXPENDITURES OF $167,500 TO PROVIDE FOR PUBLIC TRANSIT FOR THE PERIOD FROM NOVEMBER 23,1978 THROUGH DECEMBER 31,1978: AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ENACTMENT. WHEREAS, by virtue of Section 9.12 of the Home Rule Charter, the City Council may make supplemental appropriations; and, WHEREAS, available for the City Manager has certified that there are appropriation $115,000in Bus Service Contrast Revenues in excess of those estimated in the budget: and, $52,000 available to transfer from the Transportation Fund; and, WHEREAS, the City Council is advised that certain revenues and expenditures must be recognized and approved, and be so before the end of the calandar year, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 $167,500 from excess Bus Service Contract Revenues is hereby appropriated in the Public Transit Enterprise Fund. Section 2 $52,000.00 Enterprise Fund of Public Transit December 31, 1978. is hereby transferred to the Public Transit from the Transportation Fund for the purpose for the period from November 23,1978 through ,,...~,.o,,:,,.~,,,.,~.,.~o.,~...~. R E C O R D O F P R O C E E D I N G S Section 3 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. Section 4 That it hereby declared that an emergency exists requiring the immediate adoption of this ordinance inasmuch as all budget ordinances for 1978 revenues or expenditures must be fully approved by the City's governing body befor~ the end of this calandar year: that this ordinance be approved only by the unanimous vote of councilmen present or a vote of five councilmen, whichever is less; that this ordinance be passed at two meetings of council; that neither a public hearing nor forst publication be required; that this ordinance be published within Ten (10) days after final passage, and that it effect upon final passage.
