HomeMy WebLinkAboutordinance.council.054-78RECORD OF PROCEEDINGS ORDINANCE NO.~ (Series of 197~) AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION IN THE POLICE PENSION FUND THE AMOUNT OF $8,000.00 FROM PRIOR YEAR UNAPPROPRIATED RESERVES; APPROPRIATING IN THE EMPLOYEE RETIREMENT FUND THE AMOUNT OF $48,000.00 FROM PRIOR YEAR UNAPPROPRIATED RESERVES; APPROPRIATING IN THE GOLF COURSE CONSTRUCTION FUND THE AMOUNT OF $900,000.00 FROM UNAPPROPRIATED BOND PROCEEDS; APPROPRIATING IN THE WATER FUND THE AMOUNT OF $121,650.00 FROM PRIOR YEAR UNAPPROPRIATED SURPLUS; TRANSFERRING $~i,~0~.00 TO THE GENERAL FUND FOR STREET OVERLAY FROM THE PRIOR YEAR UNAPPROPRIATED WATER FUND SURPLUS; APPROPRIATING IN THE ELECTRIC FUND THE AMOUNT OF $47,305.00 FROM THE PRIOR YEAR UNAPPROPRIATED SURPLUS; APPRPRIATING IN THE 6TH PENNY SLAES TAX FUND THE AMOUNT OF $7,724.00 FROM PRIOR YEAR UNAPPROPRIATED SURPLUS; APPROPRIATING IN THE 7TH PENNY SALES TAX FUND THE AMOUNT OF $10,300.00 FROM PRIOR YEAR UNAPPROPRIATED SURPLUS; TRANSFERRING $ 4,700.00 TO THE GENERAL FUND FOR FOUNTAIN LABOR FROM THE 7TH PENNY SALES TAX FUND SURPLUS; AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ENACTMENT. WHEREAS, by virtue of Section 9.12 of the Home Rule Charter, the City Council may make supplemental appropriations; and, WHEREAS, the City Council may transfer any unencumbered appropriation balance from one department, office, agency or object to another; and WHEREAS, the City Council is advised that certain revenues and expenditures must be approved, and be so before the end of the calendar year, NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 The City Council hereby makes a supplimental appropriation of Prior Year unappropriated reserves of $8,000.00 in the Police Fund. Section 2. The City Council hereby makes a supplimentat appropriation of Prior Year unappropriated reserves of $48,000.00 in the Employee Retirement Fund. Section 3 Upon the City Manager's certification that there are available for appropriation revenues in excess of those estimated in the budget, the City Council hereby makes a RECORD OF PROCEEDINGS supplimental appropriation of unappropriated bond proceeds of $900,000.00 in the Golf Course Construction Fund. Section 4 Upon the City Manager's certification that there are available for appropriation revenues in excess of those estimated in the budget, the City Council hereby makes a supplimental appropriation of prior year unappropriated surplus of $121,650.00 in the Water Fund. Section 5 $41,700.00 is hereby transferred to the General Fund from the Water Fund for the purpose of street overlay. Section 6 Upon the City Manager's certification that there are available for appropriation revenues in excess of those estimated in the budget, the City Council hereby makes a supplimental appropriation of prior year unappropriated surplus of $47,305.00 in the Electric Fund. Section 7 Upon the City Manager's certification that there are available for appropriation revenues in excess of those estimated in the budget, the City Council hereby makes a supplimental appropriation of prior year unappropriated surplus of $7,724.00 in the 6TH Penny Sales Tax Fund. Section 8 Upon the City Manager's certification that there are available for appropriation revenues in excess of those estimated in the budget, the City Council hereby makes a supplimental appropriation of prior year unappropriated surplus of $10,300.00in 7TH Penny Sales Tax Fund. Section 9 $4~700.00 is hereby transferred to the General Fund from the 7TH Penny Sales Tax Fund for the purpose of fountain labor and mall toilet repair. RECORD OF PROCEEDINGS Section 10 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end,the ~provisions or applications of this ordinance are declared to be severable. Section 11 That it hereby declared that an emergency exists requiring the immediate adoption of this ordinance inasmuch as all budget ordinances for 1978 revenues or expenditures must be fully approved by the City's governing body before the end of this calandar year: that this ordinance be approved only by the unanimous vote of councilmen present or a vote of five councilmen, whichever is less; that this ordinance be passed at two meetings of council; that neither a public hearing nor first publication be required; that this ordinance be published within Ten (10) days after final passage, and that it take effect upon final passage.
