HomeMy WebLinkAboutordinance.council.007-79RECORD OF PROCEEDINGS ORDINANCE NO. ~ (Series of 1979) AN ORDINANCE REPEALING AND REENACTING SECTION 5-68(c)(4) OF THE ASPEN MUNICIPAL CODE TO PROVIDE FOR SEPARATE FEES FOR A FIRST OFFENSE OF RUNNING AT LARGE FOR ALTERED AND UNALTERED DOGS WHEREAS, the City Council desires to amend Section 5-68(c)(4) of the Aspen Municipal Code for the benefit of the City of Aspen, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 5-68(c)(4) of the Aspen Municipal Code is hereby repealed and reenacted to read as follows: (4) Dog running at large, first offense Section 2 If any provision of this ordinance or the to any person or circumstance is held invalid, ... $ 5.00 altered 10.00 unaltered shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or appli- cation, and to this end the provisions of this ordinance are declared to be severable. (c) Any remedies provided for herein shall be cumula- tive and not exclusive and shall be in addition to any other remedies provided by law. Section 10. Effective Date. The provisions of this ordinance shall be effective on the 1st day of January, 1980, provided the electorate approve of the imposition of this excise tax pursuant to the requirements of Section 12.1 of the Charter of the City of Aspen, Colorado. Section 11. Duration of Ordinance. This ordinance shall continue effective insofar as the levy of the Real Estate Transfer Tax is concerned through December 31, 1999; and insofar as the collection of the tax levied in the aforesaid period and actions or proceedings for collecting any tax so levied, including interest and penalties thereon, and enforcing any of the provisions of this ordinance are concerned, this ordinance shall continue effective until all of said taxes levied in the aforesaid period are fully paid and any and all suits and prosecutions for the collection of said taxes and for the punishment of violations of this ordinance shall have been fully terminated Section 12. Provisions Irrepealable or Unamendable. After the approval of the electorate for the imposition of this excise tax, Sections 3 and 8(a) providing for the amount of the tax and the application of funds shall be and remain irrepealable and unamendable without the approval of the electorate for the repeal or amendment pursuant to the requirements of Section 12.1 of the Charter of the City of Aspen, Colorado. -9- RECORD OF PROCEEDINGS 100 Leaves Section 13. Severability. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications and to this end the provisions or applications of this ordinance are declared to be severable. Section 14. Public Heariq~. A public hearing on this ordinance shall be held on ~_ _~~ ~ , 1979, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
