AN ORDINANCE RATIFYING AN EASEMENT AGREEMENT
BETWEEN THE CITY OF ASPEN AND THE ASPEN
SKIING CORPORATION PROVIDING AN EASEMENT
FOR USE BY THE ASPEN SKIING CORPORATION OF
CERTAIN CITY OF ASPEN PROPERTY
WHEREAS, there has been submitted to the City Council
a proposed easement agreement giving the Aspen Skiing
Corporation an easement to use certain City of Aspen property,
the terms of which the Council finds appropriate, and
WHEREAS, Section 9.13(b) of the Home Rule Charter
requires that all contracts requiring payments beyond the
end of the fiscal year must be approved by ordinance,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That it does ratify the agreement between the City of
Aspen and the Aspen Skiing Corporation attached hereto and
incorporated by this reference; and does further authorize
the Mayor on the effective date of this ordinance, to execute
said agreement on behalf of the City of Aspen.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions
or applications of this ordinance are declared to be severable.
Section 3
That a public hearing on the ordinance shall be held
on ~.~~A~ ~ , 1979, at 5:00 P.M. in
the City Council Chambers, Aspen City Hall, Aspen, Colorado.
