HomeMy WebLinkAboutordinance.council.023-79RECORD OF PROCEEDINGS ORDINANCE NO.~_~ (Series of 1979) AN ORDINANCE EXTENDING THE MUNICIPAL WATER UTILITY TRANSMISSION LINES BEYOND CITY BOUNDARIES WHEREAS, Section 11.3 of the Charter of the City of Aspen requires that if the Council desires to extend the municipal water utility transmission lines beyond City boundaries, it shall do so by ordinance; and WHEREAS, upon closing in accord with the terms and condi- tions of the agreement attached hereto and incorporated by reference, the City Council desires to extend the municipal water utility lines to the property described in Section 1 below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the municipal water utility transmission lines may be extended upon closing in accord with the terms and conditions of the agreement attached hereto and incorporated by reference to the following described property beyond city boundaries: A tract of land situated in the Southwest one-quarter of Section 7, Township 10 South, Range 84 West of the 6th Principal Meridian, described as follows: BEGINNING at a point whence the center 1/4 corner of said Section 7 bears N59°57'54"E, 1,042.64 feet; thence S27o51'48"W, 394.05 feet to a point on the Northerly right-of-way of Gibson Avenue; thence along said right-of-way line the following courses: 49.94 feet along a curve to the left having a radius of 386.24 feet the chord that bears N51°ll'45"W, 49.91 feet; thence N54°54'00"W, 60.12 feet; thence 2.95 feet along a curve to the left having a radius of 378.00 feet the chord that bears N54°40'35"W, 2.95 feet; thence leaving said right-of-way N23"24'52"W, 185.98 feet to a point on the Northerly right-of-way line of Red Mountain Road; thence along said right-of-way line the following courses: 39.55 feet along a curve to the left having a radius of 170.00 feet the chord that bears N0°09'58"E, 39.46 feet; thence 110.35 feet along a curve to the left having a radius of 217.76 feet the chord that bears N21°00'58"W, 109.17 feet; thence N35~32'00"W, 154.19 feet; thence leaving said right-of-way North 44.98 feet; thence N73°58'00"E, 58.68 feet; thence S71°30"12"E, 37.55 feet; thence S64~04'00"E, 345.84 feet; thence South 7.41 feet; thence S57"28'00"E, 87.99 feet to the point of beginning and containing 2.95 acres more or less. RECORD OF PROCEEDINGS Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application, and to this end the pro- visions of this ordinance are declared severable. Section 3 A public hearing on this ordinance shall be held on ~  1979, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
