HomeMy WebLinkAboutordinance.council.037-79RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 37 (Series of 1979) AN ORDINANCE TRANSFERRING $50,000 TO THE 6TH PENNY SALES TAX FUND FOR LAND PURCHASE FROM THE WATER FUND, MAKING A SUPPLEMENTAL APPROPRIATION IN THE 6TH PENNY SALES TAX FUND FROM NOTE PROCEEDS OF $265,304.20; AND APPROPRIATING AN EXPENDITURE OF $315,304.20 WHEREAS, by virtue of Section 9.12 of the Home Rule Charter, the City Council may make supplemental appropriations; and WHEREAS, the City Council may transfer an unencumbered appropriations balance from one department, office, agency or object to another; and WHEREAS, the City has recognized $265,304.20 in new revenue from note proceeds; and WHEREAS, the City Council is advised that certain transfers and expenditures must be recognized and approved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 $50,000.00 is hereby transferred to the 6th Penny Sales Tax Fund from the Water Fund for the purpose of land purchase. Section 2 Upon the City Manager's certification that there are available for appropriation revenues in excess of those estimated in the budget, the City Council hereby makes a supplemental appropriation of unappropriated revenues of $315,304.20 in the 6th Penny Sales Tax Fund for Aspen Ice Garden, Inc., a principal asset the Aspen expenditures expenditures the purpose of purchasing the stock of Colorado corporation, which has as its Ice Garden and appropriating in the amount of $50,000.00 payable in 1979 with in the amount of $265,304.20 payable in future years. RECORD OF PROCEEDINGS 100 Leaves Section 3 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or appli- cation, and to this end the provisions of this ordinance are declared severable.
