HomeMy WebLinkAboutordinance.council.043-79Reception No. ~,,~gLoretta Banner, Recorder Recorded at 9:15 A.M.- August 24, 1979 RECORD OF PROCEEDINGS ORDINANCE NO. ~ (Series of 1979) 100 Leaves AN ORDINANCE ANNEXING CERTAIN UNINCORPORATED TERRITORY TO THE CITY OF ASPEN, COLORADO WHEREAS, there has been submitted a Petition for Annexation of certain unincorporated territory to the City of Aspen, which Petition has been found to be in compliance with Section 31-8- 107(1)(c), C.R.S. 1973, a part of the Colorado Annexation Act, and WHEREAS, the City Council has considered the proposed annexa- tion as described in the Petition for Annexation (hereinafter "Petition") and accompanying plat, and has determined that: 1. The signatures on the Petition represent the owners of one hundred (100) percent of the land proposed for annex- ation. 2. Not less than one-sixth (1/6) of the perimeter of the area to be annexed is contiguous to the City of Aspen. 3. There exists a community of interest between the tracts to be annexed and the City of Aspen; the tracts to be annexed are integrated or capable of being integrated with the City of Aspen. 4. The annexation will not affect the constitution of any existent school district. 5. The Petition satisfies the statutory requirements of the Municipal Annexation Act, both as to substance and form; and WHEREAS, the Colorado vides (100) Council, may, Municipal League Annexation Act pro- that where a Petition is signed by owners of one hundred percent of the property proposed to be annexed, the City by ordinance, annex without notice or hearing (other RECORD OF PROCEEDINGS than that incident to ordinance adoption) and the City now wishes to so proceed. 100 Leaves and without election, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the following-described tract be and hereby is annexed to the City of Aspen, Colorado, pursuant to the Colorado Municipal Annexation Act: A parcel of land situated in the SW 1/4 of Section 12, and the NW 1/4 of Section 13, both being in Township 10 South Range 85 West of the 6th Principal Meridian, Pitkin County, Colorado, and being more fully described as follows: Beginning at a point on the westerly right-of-way line of Castle Creek Road, said point being N 70°10'49" E, 808.00 feet from a 1954 brass cap monument set for the southwesterly corner of said Section 12, Township 10 South, Range 85 West of the 6th Principal Meridian; thence S 21°23'00'' E, 117.07 feet along the westerly right-of-way line of Castle Creek Road; thence S 23°41'00" W, 13.13 feet; thence N 21"27'39'' E, 217.12 feet; thence S 68°37'00" E, 1.00 foot; thence N 21o23'00" W, 343.88 feet; thence N 71°00'00'' E, 10.01 feet to the point of beginning. Section 2 If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining pot- tions thereof.
