AN ORDINANCE ZONING THE MIDLAND PARK SUBDIVISION WHICH LAND
RECENTLY BEEN ANNEXED TO THE CITY OF ASPEN PURSUANT TO
ORDINANCE NO. 21, SERIES OF 1979, AND THE COLORADO
MUNICIPAL ANNEXATION ACT
HAS
WHEREAS, the City Council has recently

WHEREAS, the Aspen City Council desires that the area should
be appropriately zoned RMF-PUD,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That from and after the effective date of this ordinance the
following described property shall be zoned RMF-PUD, and subject
to those zoning regulations applicable to said zone district and
described in Chapter 24 of the Aspen Municipal Code (as now exists
or may hereafter be amended):
A parcel of land being part of the Mascotte Lode Claim
U.S.M.S. No. 5867 and the "99" Lode Claim U.S.M.S. No.
6899 and being located in Sections 7 and 18, Township 10
South, Range 84 West of the 6th Principal Meridian. Said
parcel is more fully described as follows:
Beginning at Corner 3 of said "99" Lode; thence
N89°46'00"W, 255.59 feet along the South end line of
said "99" Lode to the Easterly line of the Aspen View
Condominium Subdivision, said point of intersection
being also the Southeast corner of the Aspen Hills
Annexation to the City of Aspen as recorded in Plat Book
4 at Page 200, Pitkin County Clerk and Recorder's Office
thence N06o23,00,,W, 205.00 feet along the Easterly
boundary of Aspen Hills Annexation and the Aspen View
Condominium Subdivision to the Northeasterly corner of said
subdivsion, said corner being also an angle point on the
Southerly boundary of the Midland Park disconnection from the
City of Aspen, as recorded in Plat Book 5 at Page 76, Pitkin
County Clerk and Recorder's Office; thence along the
Southerly boundary of said Midland Park disconnection in a
clockwise direction N89o46,00,W, 215.00 feet along the
Northerly boundary of the Aspen View and the Aspen Hills

Condominium Subdivision, thence S06o23,00.E, 110.48 feet;
thence S85o44,33,,W, 38.49 feet; thence N04o54,00,,W, 19.20
feet; thence N89e46,00,,W, 144.86 feet to the Northwesterly
sidelines of said Mascotte Lode, being also the Easterly
boundary of the Anthony Berumen Annexation to the City of
Aspen as recorded in Plat Book 3 at Page 108, Pitkin County
Clerk and Recorder's Office; and being the Easterly boundary
of Sunny Park Subdivsion; thence N 38~00,00,E, 144.73 feet
along said sidelines; thence N54e07,00,E, 37.14 feet; thence
N35e53'00"W, 9.46 feet to the Southeasterly boundary of Sunny
Park Subdivision, thence N45o21,00.E, 349.36 feet along said
Southeasterly boundary to the centerline of the Salvation
Ditch; thence S21e02,00,E, 119.25 feet along said centerline;
thence S55~58,40,,E, 180.21 feet along said centerline; thence
S72~33'40"E, 245.40 feet along said centerline; thence
S34°40'20"E, 65.80 feet along said centerline to Line 3-4 of
said "99" Lode; thence S44o39,40.W, 227.58 feet to the point
of beginning, containing 4.013 acres more or less; which was
laid out, platted and subdivided into lots and blocks as
shown on the subdivision plat recorded in Plat Book 6, Page
138, Document Reception #206861, in the office of the Pitkin
County Clerk and Recorder under the name and style of MIDLAND
PARK SUBDIVISION.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect
the validity of the
